Article 4. Non-Protected Works

  1. Copyright protection shall not be afforded to:
    a) expressions of traditional folklore and art;
    b) daily news or information on current facts and events;
    c) official documents: legal acts, treaties and the official translations thereof;
    d) official symbols and signs (flags, coats of arms, medals, coins);;
    e) political speeches, speeches delivered in the court;
    f) results obtained by technical means without the intervention of human creative activity.
  2. Copyright shall not cover scientific discoveries, ideas, principles, methods, procedures, viewpoints, systems, ceremonies, scientific theories, mathematical formulas, statistical diagrams, rules of games, even if they are expressed, described, disclosed, commented in works.

Maddə 7. Müəlliflik hüququ ilə qorunmayan obyektlər

Aşağıdakılar müəlliflik hüququnun obyektləri deyildir
a) rəsmi sənədlər (qanunlar, məhkəmə qərarları, qanunvericilik, inzibati və məhkəmə xarakterli digər mətnlər), həmçinin onların rəsmi tərcümələri;
b) dövlət rəmzləri və nişanları (bayraqlar, gerblər, himnlər, ordenlər, pul nişanları, digər dövlət rəmzləri və nişanları);
c) xalq yaradıcılığı (folklor) nümunələri;
d) günün yenilikləri, müxtəlif hadisə və faktlar barədə informasiya xarakterli məlumatlar.

Şərh: Azərbaycan Respublikası dövlətlərarası və beynəlxalq topluma görə, Azərbaycan Demokratik Respublikası və Azərbaycan Sovet Sosialist Respublikasının hüquqi varisidir, buna görə də bu lisenziya teqi həmçinin də ADR və Azərbaycan SSR-nin rəsmi nişanlarına və ya formal sənədlərinə əlavə edilə bilər.

Diqqət: Bu lisenziya teqi müəllif hüquqları ilə qorunan rəsmi sənədlər, təklif olunan rəsmi simvollar və layihələrə tətbiq edilə bilməz.

Article 8. Works To Which Copyright Does Not Apply

  1. Copyright does not apply to the following works:
    a) official documents (laws, decisions of courts, other texts of administrative and normative character), as well as their official translations;
    b) official symbols of state (flag, emblem, anthem, award, monetary symbols, other official signs and symbols of state);
    c) information of events and facts.
  2. When using the works mentioned in subparagraph "b" of this Article under the other persons name, it is possible to protect the right of author's name.
